1. Scope and acceptance
These Affiliate Terms govern the PressWhizz Affiliate Program operated by PressWhizz Media LLC, a New Mexico limited liability company, at 1209 Mountain Road Pl NE Ste N, Albuquerque, New Mexico 87110, United States ("PressWhizz", "we", "us"). "You" means the individual or organisation participating as an affiliate. The program rewards eligible referrals of new customers for marketplace placements and managed placement services.
By accepting these Terms when joining the program, you agree to them. You must be at least 18 and legally capable of contracting. If acting for an organisation, you confirm authority to bind it. A separate written affiliate agreement expressly varying these Terms takes priority to the extent of the variation. These Terms govern affiliate commissions; our Advertiser or Publisher Terms separately govern purchases or publishing services. Mandatory rights remain unaffected.
2. Participation and affiliate accounts
Participation is subject to our approval. Provide accurate identity, contact, payment and any reasonably required tax information, keep it current, and protect your login credentials. We may request reasonable evidence to verify your identity, referral activity or entitlement to payment. You may not create duplicate affiliate accounts to avoid these Terms.
We use Endorsely to administer referral links, attribution, commission records and payouts. Endorsely is a service provider, not the party promising commissions under these Terms. Any terms applicable to your use of its portal do not replace our payment obligations. You are an independent contractor and have no authority to bind PressWhizz, collect money on our behalf or represent yourself as our employee or authorised sales agent.
3. Eligible customers and referral attribution
A qualifying referral is a genuinely new customer who registers a PressWhizz account through your unique affiliate link and is attributed to you under the program. Existing customers, duplicate or replacement accounts for an existing customer, and prohibited self-referrals do not qualify. A manual introduction qualifies only if we confirm its attribution in writing.
The program uses a 30-day tracking cookie and first-click attribution. Subject to valid tracking and the eligibility rules, the first qualifying affiliate click recorded within the applicable 30-day window receives attribution when the customer signs up. A later affiliate click does not override that valid attribution. The cookie window concerns the initial referral; the commission period after an attributed signup is governed by section 5.
Tracking can be affected by blocked or deleted cookies, browser settings, consent choices, different devices and technical failures. Portal figures may be provisional. If you believe a referral or commission is missing or incorrect, contact support@presswhizz.com promptly with supporting information. We will assess disputes reasonably using available tracking, account and transaction records, and correct substantiated errors. A technical problem alone does not guarantee attribution.
4. Commission rate and calculation
You earn 5% of the eligible amount paid for each qualifying placement purchased by an attributed customer, subject to a maximum commission of US$35 per individual placement. This applies to both marketplace placements and placements supplied through managed services. The cap applies separately to each placement, not once to an entire order, package, invoice or monthly managed budget.
The eligible amount is the price paid to PressWhizz for that placement after discounts, excluding taxes, separately charged payment or currency conversion fees, refunded amounts and promotional credits not funded by the customer. Separately priced writing, management and other service fees are excluded unless we expressly agree otherwise in writing. For managed packages, we use the placement amounts in the relevant order or service breakdown; the package is not treated as a single placement for the cap.
For example, a US$400 eligible placement earns US$20 and a US$1,000 eligible placement earns US$35. An order containing three eligible US$1,000 placements earns US$105, subject to these Terms.
Commission is earned only when a qualifying placement has been fulfilled and paid for with cleared customer funds. An eligible placement ordered within the applicable commission period can earn commission when fulfilled afterwards. A free signup, account balance deposit, unused managed budget or unfulfilled order does not itself earn commission. Spending deposited funds on a qualifying placement can earn commission once; the deposit and purchase are not counted twice.
5. Commission period and customer inactivity
For each qualifying customer, the maximum commission period is 36 months from the date that customer signs up for PressWhizz, subject to earlier expiry under the inactivity rule or termination provisions below. This period begins at signup, not at the first purchase, and does not restart following a purchase, plan change, account migration or replacement account.
Commission eligibility for that particular customer permanently ends if the customer places no qualifying paid order for six consecutive calendar months. Before their first qualifying order, this period is measured from signup; afterwards it is measured from their most recent qualifying order. A qualifying order for this purpose is an accepted, paid order for marketplace or managed placements, excluding orders cancelled or fully refunded. A managed agreement, account login or wallet top-up without an actual qualifying order does not reset the inactivity period.
Once the six-month inactivity period expires, later purchases by that customer do not reactivate your commission entitlement unless we expressly agree otherwise in writing. This rule applies separately to each customer. Your failure to refer new customers does not, by itself, cancel commissions from other eligible customers.
Expiry ends eligibility for new orders. It does not forfeit valid commissions already earned or commissions on qualifying orders placed before expiry that subsequently meet the fulfilment and payment requirements. The ordinary payout and adjustment rules continue to apply.
6. Payment schedule and information
Commissions are calculated and paid in United States dollars. The minimum payout is US$100 in approved commissions that have completed the payment waiting period. Smaller balances carry forward without expiring solely because they are below the minimum.
The payment term is Net-60, measured from the end of the calendar month in which the commission is earned. Commissions become eligible for payment 60 days after that month ends and are paid through the monthly payout cycle once the minimum is met and required payment information is complete. Balances that later reach the minimum do not start a new 60-day waiting period for commissions that have already matured.
Payments are made through PayPal unless we agree another method in writing. You must provide an accurate account capable of receiving payment and any invoice, tax form or verification information reasonably required to process it. We may delay affected payments while required information is missing or a specific commission is reasonably under investigation, explaining the reason and allowing you to respond. Undisputed, eligible amounts remain payable.
You are responsible for your taxes and any receiving or currency conversion fees charged by your payment provider. We may make legally required deductions or withholding and provide applicable records. Payment-provider settlement times are outside our control.
7. Refunds reversals and corrections
No commission is payable on cancelled, unpaid, fraudulent, fully refunded or successfully charged-back purchases. If the eligible placement amount is reduced, we recalculate commission using the reduced amount and the US$35 cap. A full refund reverses the associated commission, including a refund to withdrawable platform credits.
Restoration or replacement of a placement under a guarantee does not generate a second commission merely because a replacement is supplied. Any refund or adjustment is assessed against the actual customer payment retained for the affected placement, without double deductions.
We may correct errors, reverse invalid commissions, offset substantiated overpayments against future commissions, or request repayment if the remaining balance is insufficient. We will explain material adjustments and give you a reasonable opportunity to dispute them with evidence. A customer complaint alone does not establish that your referral was invalid.
8. Permitted promotion and required disclosures
Promote PressWhizz honestly and accurately using lawful methods and any brand guidance we provide. Claims about your experience must reflect your actual experience. Do not promise guaranteed rankings, traffic, revenue, indexing, AI visibility or other results that PressWhizz has not expressly committed to provide.
Clearly and conspicuously disclose your financial relationship with PressWhizz wherever required, including near affiliate recommendations and links. Use plain language explaining that you may earn a commission from referred purchases. Do not hide a required disclosure solely in your terms, profile or a distant footer. Follow applicable advertising, endorsement, privacy and electronic marketing rules, and the rules of the platforms you use.
You are responsible for your promotional content and for obtaining any permissions required for your marketing. PressWhizz does not give you permission to access customer lists, scrape personal information or send messages in our name. We may review your promotional activity and require reasonable corrections or removal of misleading, unlawful or unauthorised material.
9. Prohibited activity
You must not use your affiliate link to refer yourself, an account you operate for your own purchases, or a business you own or control. You must not route your own purchases through another person, create duplicate customer accounts, arrange reciprocal referrals to evade this rule, or otherwise manufacture a referral.
You must not use spam, purchased fake leads, bots, fabricated accounts, cookie stuffing, forced clicks, hidden tracking, unauthorised redirects, misleading coupons, attribution hijacking, payment fraud or other deceptive activity. Do not offer unauthorised rebates or incentives designed to generate artificial referrals or orders.
You must not bid on PressWhizz brand names, misspellings or confusingly similar terms in paid advertising, or register confusingly similar domains, social handles or advertising identities. Do not impersonate PressWhizz, copy its website to mislead visitors, imply an endorsement beyond your affiliate relationship, or make unauthorised promises about pricing or service terms. You must not publish confidential platform information, private customer data or unauthorised marketplace exports.
10. Brand materials confidentiality and data
During your participation, we grant you a limited, non-exclusive, non-transferable permission to use approved PressWhizz names, logos and promotional materials solely to promote the program in accordance with these Terms. We retain ownership. You retain ownership of your original content. Neither party receives a general right to use the other party's name, likeness or content beyond the permissions expressly given.
Keep non-public customer, commercial, account and program information confidential and use it only to perform your obligations and verify commissions. You may share it with professional advisers who need it and are bound by confidentiality, or where legally required. This does not restrict information that lawfully becomes public independently of a breach.
Personal information is handled as described in the PressWhizz Privacy Policy at https://presswhizz.com/privacy-policy/ and, where applicable, Endorsely's own privacy notice. Portal access does not authorise you to contact referred customers using non-public information or disclose their purchases. We may send account, payment and program administration notices using your registered contact details.
11. Suspension termination and outstanding commissions
Either party may end participation by written notice. We may suspend links, new referrals or affected payments while reasonably investigating suspected fraud, material breach or a legal restriction, and may terminate immediately for substantiated fraud, serious misconduct or a material breach not remedied within a reasonable period after notice where capable of remedy.
For ordinary termination without affiliate breach, referrals accepted before termination continue to earn commissions under the remaining original 36-month period, customer inactivity rule and other existing conditions. No new referrals qualify after termination. We will not use termination merely to avoid paying valid commissions.
If we terminate for your material breach, future commission eligibility may end from termination. Valid commissions earned before termination remain payable, except commissions affected by prohibited activity, refunds or substantiated adjustments. We will identify the basis for any withheld amount and allow a reasonable opportunity to challenge it.
On termination, stop presenting yourself as a current PressWhizz affiliate and remove promotional materials where reasonably requested. Confidentiality, payment, adjustment, liability and dispute provisions survive as necessary. Any final undisputed earned balance remains payable even if below US$100, after the applicable Net-60 period and receipt of required payment information.
12. Liability and third party claims
We do not guarantee any level of referrals, earnings or uninterrupted tracking or portal access. We will take reasonable steps to investigate reported errors, but are not responsible for losses caused solely by your equipment, unauthorised link modifications or circumstances outside our reasonable control.
To the extent permitted by law, neither party is liable to the other for indirect or consequential losses, lost profits, lost opportunities or loss of goodwill arising from this program. Each party's total liability under these Terms is limited to commissions paid or payable to you during the 12 months preceding the event giving rise to the claim. These limits do not restrict our obligation to pay valid commissions, your obligation to repay substantiated overpayments, liability for fraud, wilful misconduct or gross negligence, or liability that cannot lawfully be limited.
You will indemnify PressWhizz against reasonable third-party claims, damages and costs caused by your unlawful promotional activity, infringement of third-party rights, fraud or material breach of these Terms, to the extent attributable to you. This does not cover loss caused by PressWhizz's own breach or fault. We will promptly notify you of a claim, allow reasonable participation in its defence and not agree a settlement imposing obligations on you without your reasonable consent.
13. Changes and general provisions
We may update these Terms or close the program to new referrals by giving reasonable advance notice through the portal or registered email. Material commercial changes will be notified at least 14 days before taking effect. Changes apply prospectively and do not retrospectively reduce valid earned commissions or change the rate, cap or remaining commission period for customers already attributed under an accepted version, unless you expressly agree otherwise or a change is legally required.
These Terms are governed by New Mexico law, subject to mandatory applicable rights. The parties will first try to resolve disputes by contacting support@presswhizz.com. Unless mandatory law requires another forum, courts in Bernalillo County, New Mexico, or the United States District Court for the District of New Mexico where it has jurisdiction, have exclusive jurisdiction.
If a provision is unenforceable, the remainder continues to apply. A failure to enforce a provision is not a waiver. Neither party is responsible for delay caused by events beyond its reasonable control, but accrued payment obligations remain due. These Terms and any expressly agreed written variations form the agreement for this program.
