Definitions

Publisher: A user who offers space on their digital media for advertisements or content placements.

Advertiser: A user who seeks to place advertisements or content on the digital media owned by Publishers.

Listing: A unilateral declaration of will by the Publisher, offering their media space for use by Advertisers.

Order: An agreement between a Publisher and an Advertiser for the placement of content or advertisements.

User Accounts

Creating an account on PressWhizz is necessary to access certain services. Users must provide accurate and complete information and keep their account details updated. Users are responsible for all activities under their account.

Services Provided

PressWhizz provides a platform for Publishers and Advertisers to connect and transact. The platform facilitates the listing, discovery, and booking of media spaces for digital marketing purposes.

All transactions are conducted in U.S. dollars (USD).

The Platform offers various services including but not limited to:

• User accounts and profiles;
• Maintaining communication channels of the Users;
• Listing submittal, available for Users, registered as Publishers;
• Presenting and publishing Listings on the Platform (for Publishers only);
• The ability to add articles;
• The ability to order articles on the PressWhizz;
• If the Advertiser provides the content, the functionality allowing the creation or providing the respective content;
• Browsing Listings;
• Placing Orders;
• Administration and management of the system for placing Orders, including access to Order history;
• Access to payment history;
• Supervising order execution and User cooperation;
• Management of complaint system and terminations;
• Provision of exterior billing systems;
• Additional users management
• Newsletter access

Payments on the Platform

Prices for listings and services on PressWhizz are set by the Publishers and are displayed in U.S. dollars.

Payment for services must be made through approved payment methods, which include credit cards, PayPal, and bank transfers.

PressWhizz may charge a commission fee on transactions, which is included in the final price paid by Advertisers.

Content Guidelines

Users must ensure that the content they provide or interact with does not violate any laws, infringe on any rights, or contain harmful or prohibited material. PressWhizz reserves the right to remove any content that violates these guidelines.

Rights and Obligations

Publishers must have the rights to offer the media spaces they list and ensure that their listings are accurate and lawful.

Advertisers are responsible for ensuring that their content is legal and complies with the terms agreed upon in their Orders.

Users are fully responsible for the consequences of publishing content that violates the law or third-party rights. The company is not responsible for these violations.

Privacy and Data Protection

PressWhizz respects the privacy of its users. Our Privacy Policy, available on our website https://presswhizz.com/privacy-policy, describes how we collect, use, and protect personal information.

Modifications to Terms

PressWhizz reserves the right to modify these Terms and Conditions at any time. Users will be notified of any changes, which will be effective immediately upon posting on the website.

Refunds

Refunds at PressWhizz are issued under the following conditions:

• Order Non-Completion: If an order is not completed as agreed, the funds will be returned to the buyer’s wallet balance on the platform.
• Dissatisfaction with Completed Order: If a user is not satisfied with a completed order—for reasons such as incorrect anchor text or modifications to the original content and the publisher disagrees to make the changes a refund may be issued back to the user’s wallet balance.
• Order Confirmation: Once an order is completed and confirmed by the buyer, no refunds will be available.

Disclaimer and Liability

PressWhizz provides its platform and services “as is” without any warranties, express or implied. The company is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the platform.

Additionally, PressWhizz does not guarantee the continuous operation or access to websites, nor the permanence of link placement, traffic consistency, or website indexing by search engines such as Google. 

Changes to search engine algorithms, website ownership, or web content that may affect search rankings and visibility are outside the control of PressWhizz. Users acknowledge that elements such as site crashes, traffic fluctuations, or deindexing are inherent risks in digital marketing and SEO, over which PressWhizz has no influence.

Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the State of Delaware, without regard to its conflict of law provisions.
