PRESSWHIZZ LEGAL

Advertiser Terms

Last updated 15 October 2026

18 sections

1. Scope and acceptance

These Advertiser Terms govern purchases from PressWhizz Media LLC, a New Mexico limited liability company, at 1209 Mountain Road Pl NE Ste N, Albuquerque, New Mexico 87110, United States ("PressWhizz", "we", "us"). They cover our website, platform and advertiser services, including placements, link insertions, article writing, packages and managed campaigns. "You" means the customer purchasing or using those services.

By accepting these Terms when registering or ordering, you agree to them. If acting for an organisation, you confirm that you have authority to bind it. You must be at least 18 and legally capable of contracting. These Terms cover orders placed through the platform or agreed with our authorised representatives through written communications.

A separately agreed written contract expressly varying these Terms takes priority over them. Accepted order specifications govern the particular deliverables and price; these Terms otherwise apply. Mandatory rights that cannot lawfully be excluded or restricted remain unaffected, including any applicable consumer rights.

2. Accounts and customer authority

Provide accurate account and billing information, protect your credentials, and promptly report unauthorised access. You are responsible for orders and instructions submitted by your authorised account users. Do not share access outside your organisation or approved team.

If buying for a client or another brand, you confirm that you are authorised to supply its materials, approve work and give the necessary instructions. You remain responsible for payment and compliance with these Terms regardless of your arrangements with that client. Permission to order services does not, by itself, authorise publicity for that client under section 12.

3. Our services and publishers

You contract with PressWhizz for the services specified in your order. We may use independent publishers, writers and other suppliers to fulfil them. We arrange publication on third-party websites; we do not own or control those websites or their editorial and operational decisions. This does not remove our express obligations under your order or the link-removal guarantee below.

Listing availability, prices and publisher requirements can change before an order is accepted. If an ordered placement is unavailable or requires a material change, we will seek your agreement to an alternative or return the affected amount as platform credits. We will not substitute a different website for a specifically selected placement without your approval, except within authority you have expressly delegated for a managed campaign.

Website metrics displayed on PressWhizz, including estimated traffic, Domain Rating, Domain Authority, backlink counts, keyword rankings and other data from Ahrefs, Moz or similar providers, are third-party estimates or measurements supplied for information. They reflect data retrieved at a particular time and may be cached, periodically refreshed or delayed. We do not represent that displayed metrics are live, current to the day, or identical to the provider’s dashboard at the time of ordering or publication. Providers may change their data, indexes, estimates and methodologies independently of PressWhizz, and metrics may increase or decrease at any time before or after ordering or publication. We do not guarantee the continued accuracy, availability or maintenance of any metric or traffic level. A subsequent fluctuation, provider recalculation or difference from a provider’s current dashboard does not, by itself, entitle you to cancellation, replacement or refund. Any minimum metric expressly agreed as a binding requirement in an accepted order remains subject to that agreement. This provision does not excuse a knowingly misleading listing or override mandatory rights.

4. Prices payments and platform credits

Prices and separately charged writing fees are shown in the order or agreed quotation. Transactions are in USD unless expressly agreed otherwise. Applicable taxes and any payment charges payable to us will be disclosed before purchase. Future price changes do not alter an accepted order without agreement.

Orders require sufficient prepaid funds unless we agree another payment arrangement in writing. Invoices under an agreed credit arrangement are payable by their stated due dates. You authorise charges for orders and recurring payments only to the extent you have agreed to them.

Funds you deposit are available for future PressWhizz purchases. Unused deposited funds are fully withdrawable on request through the platform or support. Funds committed to an accepted order remain subject to the order, cancellation and refund provisions of these Terms. Balances are non-transferable between customers and currently have no expiry date. They are not publisher earnings or a bank account. Promotional credits and other credits granted without payment are not redeemable for cash unless we expressly agree otherwise; any additional promotional conditions will be disclosed when issued.

Refunds under these Terms are first credited to your platform balance. Refunds attributable to amounts paid by you remain withdrawable, including refunds for an unfulfilled placement or an unresolved guarantee claim. A refund of promotional or other unpaid credits restores that type of credit and does not convert it into withdrawable cash. We may reasonably verify account ownership and the payment source before processing a withdrawal, but verification does not remove your entitlement to withdraw eligible funds. We will not retroactively impose an expiry date on existing paid balances. Account closure or suspension does not by itself forfeit unused paid funds or prevent their return, subject to lawful holds and amounts properly committed or owed. Mandatory refund rights remain unaffected.

We may investigate suspected fraud, unauthorised payments or payment disputes and pause affected work while doing so. You must pay undisputed amounts owed. Nothing here restricts a payment dispute or other remedy available under mandatory law.

5. Orders cancellation and delivery

Provide the target URLs, anchors, content, brief and other information required for your order. The agreed order requirements determine the deliverable, subject to applicable law and disclosed publisher requirements. We may refuse unlawful or prohibited work.

You may request cancellation before the publisher accepts the order. Once the publisher has accepted, the placement cannot be cancelled at your discretion, even if publication has not yet occurred. This does not remove remedies for non-performance or mandatory legal rights. If an order is cancelled and separately ordered article writing has been completed, its disclosed charge will be deducted from the amount credited.

Turnaround times are estimates unless we expressly agree a firm deadline in writing. Publication depends on publisher schedules, customer cooperation and approvals. Delayed customer materials or responses can extend delivery. If a publisher cannot complete an accepted order, we will seek an agreed alternative or credit the unfulfilled placement amount. An estimate passing does not, by itself, entitle you to cancel an accepted order. However, if an accepted placement remains undelivered for an unreasonable period, you may request resolution through the platform or support. We will address the request within a reasonable period by agreeing a revised delivery date or alternative with you, or crediting the unfulfilled placement amount. An unresolved order will not remain indefinitely committed solely because the publisher originally accepted it. Credits attributable to paid funds are withdrawable under section 4.

Publication services are delivered when the agreed content or link is published and we provide the live URL. Article-writing services are delivered when the article is made available for review. Delivery remains subject to the review process and express guarantee below.

6. Reviews approvals and revisions

You have seven calendar days after notification that a site selection, article or completed placement is available for review to approve it or submit a specific objection or revision request through the platform or the notified communication channel. If you do not respond within that period, the item is automatically approved. Approval of a site or article authorises the next fulfilment step; approval of a completed placement confirms delivery for operational and payout purposes.

A timely objection or revision request pauses automatic approval of the affected item while it is unresolved. If a revised item is submitted for approval, a new seven-calendar-day period begins when you are notified. Unaffected items can continue through fulfilment.

We may determine, acting reasonably and on the available evidence, whether an objection identifies a failure to meet the accepted order. We will explain our assessment and give you a reasonable opportunity to provide relevant information. An objection unrelated to agreed requirements, a change of preference or a request for additional scope does not by itself prevent approval of properly completed work. If a dispute remains unresolved or you stop responding, we may conclude the initial approval process on the available evidence within a reasonable period. This does not remove valid delivery remedies, the link-removal guarantee or mandatory rights.

Corrections needed to meet the original agreed writing brief are included. A new topic, changed brief, expanded scope or changes requested after approval may incur additional charges, which require your agreement before the extra work begins.

Approval does not waive the 12-month link-removal guarantee or mandatory rights. After approval, a change of preference or the absence of manual approval alone does not establish a delivery defect. For an actual failure to meet the agreed order, we will seek correction or agreed replacement; if the failure cannot be resolved, the affected unfulfilled amount is credited.

7. Managed campaigns

Managed campaigns operate on the recurring budget, scope and payment arrangements agreed with you in writing, including through the platform or email. These Terms impose no fixed minimum spend, minimum term or standard notice period. Any such commitment must be separately agreed.

You may retain approval of proposed websites and articles, in which case section 6 applies, or expressly authorise us to select and proceed within an agreed brief without item-by-item approval. You may change that authority prospectively for work not already committed.

You may ask to stop future campaign work through the platform or your account contact. Unless a separate written commitment applies, we will stop new commitments once the request is received and processed without unreasonable delay. Accepted publisher orders and completed writing remain payable. Uncommitted prepaid amounts remain available for future purchases or withdrawal under section 4; they are not forfeited merely because a month ends.

8. Twelve month link removal guarantee

Each paid link placement is protected against link removal for 12 months from its original publication date. Removal includes deletion of the article containing the paid link and permanent closure of the publisher’s website where the paid link is no longer accessible. Temporary downtime alone does not establish permanent removal; we will investigate whether access can reasonably be restored. If a covered link is removed during the guarantee period, notify us through the platform or support with the order and affected URL so that we can investigate.

An unauthorised change to the link destination so that the paid link no longer points to the agreed target URL is treated as link removal for purposes of this guarantee. A change expressly requested or approved by you is not removal for this purpose.

We will first attempt to restore the link. If restoration is not possible, we will seek a replacement on a reasonably equivalent website, taking account of relevance, available metrics and placement value. We will propose the replacement for your approval under section 6. If we cannot restore or provide an equivalent replacement within a reasonable period after your report and provision of the information reasonably needed to investigate, we will credit the price paid for the affected placement to your platform balance. Restoration or replacement attempts will not postpone resolution indefinitely. Credits attributable to paid funds are withdrawable under section 4. A replacement carries only the unexpired balance of the original 12-month guarantee, measured from the original placement’s publication date; it does not start or extend the guarantee. A replacement removed during that remaining period is subject to the same restoration, replacement or credit process.

The guarantee does not apply to removal you request or cause through unlawful materials or a breach of these Terms. It covers link removal only. Changes to link attributes, including dofollow, nofollow or sponsored status, are outside this ongoing guarantee and may be determined by the publisher. This does not excuse initial delivery that fails to meet expressly agreed order requirements. We do not guarantee Google or other search-engine indexing. Restoration, replacement or a placement credit is the contractual remedy for covered removal, subject to mandatory rights and the withdrawal provisions in section 4.

9. Customer materials and content rights

You retain rights in materials you supply and grant us and our fulfilment suppliers permission to use, reproduce, edit as needed for the agreed brief, and publish them to perform your order. You confirm that you have the required rights and permissions for supplied text, images, logos, claims and links, and that your instructions and promoted products comply with applicable law, including advertising and industry restrictions.

You are responsible for the accuracy and legality of facts, product claims and instructions you provide, including when incorporated into an article we arrange to write. Publishers may require lawful advertising disclosures or refuse content inconsistent with their disclosed editorial requirements.

Purchasing a placement, including any associated writing service, does not by itself transfer ownership of the article or grant rights to reproduce, edit or republish it elsewhere. The article is supplied for publication on the agreed publisher website, and any rights to use it beyond that placement must be separately agreed in writing by the relevant rights holder. Standalone writing services, where offered, will specify the applicable usage rights before purchase. Third-party images and other licensed assets remain subject to their applicable licences. Our platform, software, branding, inventory database and pre-existing materials remain ours or our licensors’.

10. Prohibited use and bypassing PressWhizz

You must not scrape, crawl, harvest, bulk export or systematically copy our marketplace, listings, publisher details, prices or database, whether manually or through scripts, bots, browser tools or other automated means. This restriction does not prevent use of an export or integration feature we expressly authorise for its stated purpose.

You must not use information obtained through PressWhizz to solicit publishers, negotiate or place transactions outside PressWhizz to avoid our platform or fees, or enable another person to do so. You must not resell, disclose or use our inventory as a lead list. This applies to direct and indirect circumvention.

These marketplace restrictions and section 11 do not prevent an agency or reseller from sharing information about placements purchased for an authorised client with that client, or from exporting its own order records through authorised features. Such reporting must not disclose unrelated marketplace inventory, misuse third-party confidential information or facilitate circumvention. This exception does not authorise public disclosure of private campaign or marketplace information.

Do not interfere with platform security, impersonate others, submit fraudulent orders or provide unlawful or infringing materials. We may restrict access for breaches and pursue available legal remedies. Nothing in this section restricts honest customer reviews or legally protected disclosures.

11. Confidentiality

Each party must protect the other’s non-public commercial information received through the relationship, including private pricing, campaign instructions, placements, account information and communications. Use it only to perform or receive the services, and disclose it only to people and suppliers who need it for that purpose and are subject to appropriate confidentiality obligations.

This does not cover information already lawfully known, independently developed, lawfully received without restriction or publicly available without a breach. Legally required disclosure is permitted, with advance notice where lawful. These duties continue for as long as the information remains confidential. Publicity expressly permitted by section 12 is an agreed exception.

12. Customer references logos and case studies

Unless you opt out as described below, you grant PressWhizz a non-exclusive, royalty-free permission to identify your organisation as a customer and display its name, logo and trademarks in customer lists, homepage logo displays, presentations and other marketing. You also permit accurate named case studies describing your use of PressWhizz, genuinely anonymised order examples, and ranking or visibility information available from public sources or tools we are authorised to use, such as Ahrefs.

This permission does not allow disclosure of private placement URLs or publisher lists, non-public prices or spend, identifiable order volumes, private campaign instructions, communications, personal information or account screenshots containing such information without separate permission. Anonymised examples must not reveal those details by allowing an individual order or placement to be identified.

We will describe the relationship accurately, follow reasonable brand guidelines supplied to us, and will not imply an endorsement, quote or proven causal effect on rankings that has not been substantiated. Your trademarks remain yours. An agency or reseller grants publicity rights for an underlying client only where expressly authorised by that client; otherwise this permission concerns the agency or reseller itself. Where underlying-client publicity is authorised, we may accurately describe work delivered through agency partners without naming the agency, provided this does not breach an agreed restriction or imply that the brand contracted directly with or endorsed PressWhizz.

You may opt out of names, logos, case studies or all publicity at any time through the platform or our website contact form. We will stop new use on receiving the request and remove affected material from online channels we control within 10 business days. We will stop future distribution of affected printed materials; we cannot recall materials already distributed or control independent third-party copies and caches. A separately agreed confidentiality or publicity restriction takes precedence.

13. Privacy and service information

Our Privacy Policy explains how we process personal information. Performance of your orders may require sharing relevant briefs, content and contact information with fulfilment suppliers as described there. Section 12 does not override applicable data-protection requirements or provide permission to publish an individual’s personal information.

We may send registration, account, onboarding, order, approval, payment, security and legal messages through the platform or to your registered email address, and through WhatsApp where you have provided the required permission. We may introduce manual telephone calls by our team concerning account setup, genuine verification, security, support or orders, and service or sales follow-ups where permitted and subject to applicable permissions and preferences. Keep contact details current and monitor notices. Providing a phone number or accepting these Terms does not itself grant any separate marketing or messaging consent required by law or the messaging provider. Our Privacy Policy explains information use and communication choices. You may ask us to stop WhatsApp messages or promotional calls; necessary notices may continue through another appropriate channel. These provisions do not authorise automated, prerecorded or AI-generated calls.

14. Service limitations

Except for commitments expressly made in an accepted order or these Terms, services and platform access are provided as available, to the fullest extent permitted by law. We do not guarantee rankings, traffic, leads, revenue, search-engine or AI visibility, or compliance with search-engine policies. Search engines may discount paid links or take other action. You decide whether the services suit your marketing strategy.

We do not guarantee uninterrupted platform or publisher-site availability. Algorithm changes, changing website metrics and publisher editorial decisions may affect results. These limitations do not override our agreed deliverables, express link-removal guarantee or mandatory legal duties.

15. Indemnity and liability

To the extent permitted by law, you will indemnify PressWhizz against third-party claims and reasonable resulting losses, damages and legal costs caused by your unlawful or infringing supplied materials, your lack of necessary authority, or your material breach of these Terms. This does not extend to the extent a claim results from our own breach, negligence or misconduct. We will notify you promptly, allow reasonable participation in the defence and not agree a settlement imposing obligations on you without your consent, not to be unreasonably withheld.

To the fullest extent permitted by law, neither party is liable to the other for indirect or consequential loss, lost profit, lost revenue, loss of customers or contracts, lost business opportunities, loss of goodwill or anticipated savings arising from the services. Subject to the exceptions below, PressWhizz is not liable for loss of search rankings, traffic, indexing or online visibility, or for loss of a customer, contract, revenue or profit alleged to result from a publication delay or the SEO effects of a placement. This does not remove our express delivery obligations or the correction, replacement and credit remedies provided in these Terms.

To the fullest extent permitted by law, PressWhizz’s total aggregate liability arising out of an affected order is limited to the price paid for that order. Claims unrelated to a specific order are limited to the service fees paid by you during the 12 months preceding the event giving rise to the claim. Amounts paid for the same loss under a refund or credit remedy count towards the applicable cap.

Nothing excludes or limits liability for fraud, wilful misconduct, gross negligence, or any liability that cannot lawfully be excluded or limited. These limitations do not extinguish unused paid credits or mandatory refund rights.

16. Suspension termination and events beyond control

We may suspend affected access or services where reasonably necessary to address fraud, security issues, overdue undisputed payments, unlawful activity or material breaches of these Terms. Where practicable, we will explain the reason and allow correction; urgent risks may require immediate action. Either party may terminate the relationship for a material breach not remedied within a reasonable period after notice.

You may request account closure through support. Closure does not cancel accepted orders, erase payment obligations or remove accrued rights. Unused paid funds and eligible refunds remain withdrawable under section 4, subject to lawful holds and amounts properly committed or owed. Confidentiality, accrued payments, content licences, liability, dispute provisions and restrictions concerning previously obtained marketplace information survive as applicable. Publicity remains subject to your opt-out right.

Neither party is liable for delay caused by events beyond its reasonable control that it could not reasonably prevent or overcome. The affected party must notify the other and take reasonable steps to mitigate the effects. This does not excuse payment for delivered services or remove remedies for an order that cannot be fulfilled. Ordinary publisher scheduling does not by itself extinguish our fulfilment obligations.

17. Complaints governing law and other provisions

Report complaints through the platform or support@presswhizz.com, including the order reference, issue and supporting information. We will investigate and seek a practical resolution. Where mandatory law permits, disputes are governed by New Mexico law, excluding its conflict-of-laws rules, and subject to the exclusive jurisdiction of state courts in Bernalillo County, New Mexico, or the United States District Court for the District of New Mexico where federal jurisdiction exists. This does not displace mandatory consumer protections or any non-waivable right to use another court.

These Terms and your accepted order or separate written agreement form the entire agreement concerning the relevant services. If a provision is unenforceable, the remainder continues to apply to the extent lawful. A failure to enforce a provision is not a waiver. Neither party may transfer an agreement without the other’s consent, except as part of a merger, reorganisation or sale of the relevant business where customer rights are preserved.

We may update these Terms prospectively by notifying you through the platform or email at least 14 days before material changes take effect. Accepted orders remain governed by the version accepted for them unless otherwise agreed or required by law. New terms apply to future orders when accepted. No amendment retroactively grants new publicity rights or removes accrued guarantee rights without your agreement.
